Technical Support

Accreditation Now offers Technical Support for users accessing our website. The Technical Support Staff are not CARF experts, consultants or Surveyors. Accreditation Now does have consultants that can be contracted to your organization. Please email info@accreditationnow.com for rates and particulars.

Data Security

Accreditation Now implements administrative, technical, and physical safeguards designed to protect Customer data, including PHI where applicable. These safeguards include, but are not limited to, encryption of data at rest and in transit, access controls, and activity logging.

Customer acknowledges that no system can be guaranteed to be 100% secure and agrees to use the platform in a manner consistent with applicable security best practices, including maintaining the confidentiality of login credentials and limiting access to authorized users.

Privacy

Use of the Accreditation Now platform is also governed by our Privacy Policy, which describes how we collect, use, and protect information.

Use of Protected Health Information (PHI)

Certain features of the platform, including but not limited to the Waiting List and Incident Report modules, may allow Customer to store or process information that constitutes Protected Health Information (“PHI”) as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).

When Customer uses the platform to create, receive, maintain, or transmit PHI, Accreditation Now acts as a “Business Associate” as defined under HIPAA.

Customer agrees that PHI will only be stored in designated areas of the platform intended for such use. Customer shall not store PHI in free-text fields or modules not specifically designed for PHI, including but not limited to compliance reports, grievance submissions, or other unrestricted input areas.

Customer is solely responsible for determining whether the data entered into the platform constitutes PHI and for ensuring compliance with all applicable laws and regulations.

Use of any feature that involves PHI is subject to the Accreditation Now Business Associate Agreement (“BAA”), which is incorporated by reference into these Terms. By using PHI-enabled features of the platform, Customer agrees to the terms of the BAA.

Acceptable Use of the Platform

Customer agrees not to use the platform to store or transmit sensitive information, including PHI, in any area not explicitly intended for such use. Misuse of the platform in this manner may result in suspension or termination of access.

Purchase Agreement

By accepting the User Agreement from Accreditation Now ("www.accreditationnow.com"), you ("Customer") agree to be bound by the terms and conditions listed below. You and Accreditationnow.com agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Accreditation Now. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you subscribe or renew your subscription with Accreditationnow.com.

Limitation of Liability

IN ALL CIRCUMSTANCES ACCREDITATIONNOW.COM'S MAXIMUM LIABILITY IS LIMITED TO THE PRICE OF THE SUBSCRIPTION PURCHASED. ACCREDITATIONNOW.COM SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE SERVICE IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. ACCREDITATIONNOW.COM SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT AccreditationNow.COM HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Subscription

A subscription to Accreditation Now entitles the purchaser for access to our online computer system for One Year. The Customer is allowed to download any and all documents in our Document Section, allowed to use any and all online tools including but not limited to - online trainings, job description entry maintenance and review, critical incident entry, reporting and summary, and online policy creation and review.

Policy and Document Usage

The policies, procedures, forms, and materials developed, generated, and contained on accredititionnow.com, including all electronic versions, are protected by copyrights owned by Accreditation Now. They may be used only for your personal use and may not be distributed or sold. Any distribution of these materials beyond the purchaser and the purchaser's organization is strictly prohibited and a violation of federal copyright law. It is your responsibility to ensure that all materials accessed through accreditationnow.com are reviewed and are consistent with all applicable laws. State and local laws vary significantly and are subject to change. Accreditationnow.com is not intended to be a substitute for legal advice and a measured and fully organized approach to receiving national accreditation. Accreditation Now does not guarantee that use of our materials will result in successful accreditation outcomes.

Program Locations

• If an organization has multiple program locations and each site's ongoing/daily administrative and clinical services are directed/managed by the same individual or individuals, a single subscription's tools, resources, and documents (and the cost of that subscription) can be applied to, and used at all sites.
• If an organization has multiple program locations and each site's ongoing administrative and/or clinical services are directed and/or managed by different individuals, this subscription, and the resources obtained through the subscription, cannot be used or applied to the administrative or clinical operations of the additional program sites. In this situation, a separate subscription and agreement is required for each site.

Shipping Charges

There are no shipping charges related to Accreditation Now Online Services.

Severability

If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Oklahoma law.

Refund Policy

Once an organization has purchased a subscription and been granted access to the website to download materials or use the online tools, no refunds or exchanges are permitted.

Waiver

The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Related Agreements

The Privacy Policy and, where applicable, the Business Associate Agreement (BAA), are incorporated into these Terms by reference and form part of the overall agreement between Customer and Accreditation Now.

Entire Agreement

These terms and conditions are the complete and exclusive agreement between Accreditation Now, Inc. and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Accreditation Now, Inc. and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
